In accordance with the art. 10 of the Law 34/2002, July 11, of Services of Information Society and Electronic Commerce, we inform that www.palcam.cat is a domain owned by the company LICEO PALCAM SLU (hereinafter PÀLCAM), with CIF B-08439960 and registered office at Rosalía de Castro, 32 (08025) Barcelona, Spain; and its contact email is palcam@palcam.cat .

It is registered in the Mercantile Registry of Barcelona in volume 23.666, document 72, page nº B 56.891. 

TERMS OF USE

PÀLCAM is a state-funded school in the neighborhood of el Guinardó that offers education since the age of 3 at preschool, primary, secondary, baccauleureate and vocational training. Thanks to a customer oriented website and the use of the information technologies and communication, a high quality response and costumer’s satisfaction is offered.

The use of this website is governed by the present Terms of Use, including those contents and services made available to users. For this reason, PÀLCAM calls for the perusal of these conditions because they contain all the information concerning your rights and obligations.

With the mere access to the website you will be considered as “user” and, thus, it is assumed that you have explicitly accepted, automatically and voluntarily, all the general conditions applicable at all times that you visit it. PÀLCAM exclusively reserves to itself the right to review at any time these Terms of Use whether for legal reasons or by choice, pledging to publish or notify any change, and these are accepted and understood if the user continues to use the service

On occasion, these terms and conditions could be supplemented or replaced by Particular Conditions for new contents and/or services offered on the website. In the event of some kind of conflict between these conditions and a particular case, the latter prevails.

Similarly, PÀLCAM holds the right to modify, at any time and without further notice, the structure and design of the website, to edit or to delete content or services, or these terms of use.

DUTIES AND RESPONSABILITIES OF USERS

While using this website, the user agrees not to violate any of the following: the law, good faith, generally accepted uses, or public order. Therefore, you must not use the website for illegal, misleading, malicious or harmful to others purposes.

The user must have an appropriate behaviour, thus, he/she agrees not to undertake any conduct that could damage the image, interests and/or rights of PÀLCAM and/or thirds, or which could damage, disable or overburden the Website or impede, in any way, its normal use. The user should refrain from attempting to access, use and/or manipulate data of PÀLCAM.

For specific content and/or services, the user should provide personal data. For this reason, he/she commits to provide truthful information and to be solely responsible for any damage that the inaccurate or false statements of this information may do to PÀLCAM or thirds. 

PÀLCAM adopts reasonably adequate security measures in order to detect the presence of viruses. However, the user must be aware that security measures of computer systems on the Internet are not entirely reliable, and therefore, PÀLCAM cannot guarantee the absence of viruses or other elements that may cause changes in computer systems (software and hardware) or electronic documents and user’s files.

Meanwhile, the user is encouraged to refrain from introducing or spreading on our network computer viruses or any other physical or logical systems that are capable of causing damage to the physical or logical systems of PÀLCAM or third parties.

Finally, PÀLCAM holds the right to deny access to a user at any sign of fraudulent use of the offered services, as well as to take appropriate legal action in defence of its interests or to temporarily suspend, without prior notice, the access to the website because of maintenance, reparations, renovation or improvement.

INTELLECTUAL PROPERTY. ADMISSION OF BACKLINKS / HYPERLINKS

The content shown in the website and, in particular, the designs, text, images or photographs, graphics, logos, icons, buttons, software, trade names, trademarks or any other sign of its use on a commercial or industrial level, are subject to legislation on intellectual property and are owned by PÀLCAM or third parties who have authorized its publication on the website.

Under no circumstances, shall any license granted mean or waiver, transfer all or part of such rights or grant the right or expectation of rights, and in particular, alteration, exploitation, reproduction, distribution or public communication of the contents without prior express authorization of PÀLCAM or the owners.

Furthermore, when using these conclusions, the user agrees not to reproduce in any way the website or any of its content without express written permission of PÀLCAM.

However, the user is granted a limited, revocable, and nonexclusive right to create links solely to the homepage of the website for the private non-commercial use (hyperlink / backlink). Websites that include a link to our website:

– May not imply that PÀLCAM recommends that website or its services or products, or to lie about its relationship with PÀLCAM.

– Must not contain content considered distasteful, obscene, offensive, controversial, inciting violence or discrimination based on sex, race or religion, contrary to public policy or illegal.

– Must link to the website itself, without allowing PÀLCAM website to be a part of their website, nor to be present in one of their “frames” nor create a “browser” on any page of the website. PÀLCAM may, at any time, ask for the removal of any link to its website, which shall be done immediately.

PÀLCAM cannot control the information, content, products or services provided by other websites that have established links to PÀLCAM website. For this reason, we are not responsible in any way of these websites.  

PÀLCAM authorises to link to its website from any other website, without the express prior consent of PÀLCAM.

CORPORATE RESPONSABILITY

PÀLCAM is not responsible for the deficiencies of the service provided by the server, nor for any network communication problems or malfunctions resulting from the use of non-optimized versions of any browser. Also, PÀLCAM cannot be held liable for failing to provide its service as a consequence of an extended power outage, fail in telecommunications lines, social conflicts, strikes, explosions, floods, acts and omissions of the Government service, and generally all cases of major force or fortuitous event.

Both the access to the website and the use given to the information contained in it is the sole responsibility of the user.

PÀLCAM is not responsible for any consequence or damage that may arise from such access or misuse of information. It will only be responsible of removing as soon as possible any content that may generate some kind of loss or damage, provided this is notified or becomes aware.

PÀLCAM cannot be held liable for any security errors that may occur, nor for any damage caused to the user’s computer system, files or documents in the same store as a result of the presence of viruses in computer used to connect to the website. It will not be held liable either for the consequences of a malfunction of the browser or the use of non-updated versions of telephone faults, interference, omissions, or disconnections in the operation of the electronic system caused by reasons beyond the activity of PÀLCAM.

CONFLICT RESOLUTIONS. APPLICABLE LAW AND JURISDICTION

These Terms of Use are governed by the Spanish law and, in particular, the Law on the Protection of Personal Data (Reglamento General De Protección De Datos REGLAMENTO (UE) 2016/679 DEL PARLAMENTO EUROPEO Y DEL CONSEJO de 27 de abril de 2016 relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y por el que se deroga la Directiva 95/46/CE) and Law of Informaton Society Services (Law 34/2002, of July 11, of Information Society Services and Electronic Commerce). Any dispute will be resolved in the courts of Barcelona.
